When you use this website or the fdm application, you enter into an agreement with Ferra Solutions (Pty) Ltd.

The terms of this agreement are set out below. By accessing the web site or using the application, you acknowledge that you have read, understood, and agreed to the terms of this agreement and to comply with any laws and regulations that may be relevant to you.

If you do not agree to these terms, please refrain from accessing the web site and from using the application.

Ferra Solutions (Pty) Ltd may at any time and without notice revise the terms of this agreement, change the content of its web site or improve, update or otherwise change the fdm application.

Ferra Solutions (Pty) Ltd grants you non-exclusive, limited and non-transferable access to its web site, the fdm application and related materials, including but not limited to manuals and examples contained in the website and in the application. Content such as manuals and examples, that are not generated by you, but that is already present in the application or available on the web site, or that is made available later through updates or other changes, may not be sold or published by you. Ferra Solutions (Pty) Ltd does not grant you any express or implied proprietary or intellectual property rights.

The fdm application allows you to download data from third parties. You do so independently of Ferra Solutions (Pty) Ltd. Here the application functions as a tool to conveniently obtain data from those third parties and you do so under the terms of use of the applicable data provider and any laws and regulations that may apply to you in using the data. Any copyright or trademark information applicable to the data must still be adhered to. Ferra Solutions (Pty) Ltd does not own the data nor does it grant you any express or implied rights to data, nor does usage of its application or web site grant you any such rights.

Disclaimer

The fdm application implements a wide variety of techniques, some of which are documented in its manuals or illustrated in examples. The implementation of these techniques is in many ways experimental. The application uses an arbitrary precision calculator that has been developed from the ground up. The way in which numbers are stored and the way in which even basic mathematical operations, such as addition and multiplication, are performed are novel and unique. Whilst this is done specifically in order to improve the accuracy of calculations, the application may contain bugs and results may contain inaccuracies. The manual and examples may contain inaccuracies, be incomplete or have typographical errors.

Use of the web site and the fdm application is at your own risk. All content and software are provided as is and without any implied warranties or guarantees. Ferra Solutions (Pty) Ltd makes no warranty that results will be accurate, that use of the web site or application is secure or that the application is error free or that techniques are implemented, documented or illustrated correctly.

You agree that your use of the web site or fdm application is entirely at your own discretion and risk and that you alone will be responsible for any damages that may result as a consequence of you using the web site or application.

In particular, the fdm application may be used to model and forecast with. The web site or manuals or other content may discuss techniques that are of a forward looking nature or that support making decisions with. Such decisions are inherently uncertain and risky and actual results may differ materially from expected or simulated or calculated or implied outcomes. Using the web site or application in any way to forecast or project or make decisions with is encouraged but still entirely at your own discretion and risk and is not a substitute for professional advice. If you are unsure about any technique or its application, or if you need to make any decision, you are advised to seek professional assistance and to verify results using independent tools.

Limited liability

Ferra Solutions (Pty) Ltd, its directors, officers, employees and agents will not be liable to any party for any damages of any type whatsoever arising from the use of or inability to use the web site or fdm application.

This liability will be limited to the fullest extent permitted by applicable laws and includes any direct or indirect, general or special, incidental, consequential, exemplary or punitive damages arising from or directly or indirectly related to the use of or the inability to use the web site or application. Damages thus limited include, but is not limited to, loss of data, loss of use, loss of income or profit, loss of credibility, loss of value and loss through claims by third parties. This limited liability remains in place even if Ferra Solutions (Pty) Ltd has been advised of the possibility of such damages or losses. This limited liability remains in place whether the damages or losses are based on contract, tort, strict liability or any other legal basis or theory.

Some jurisdictions do not allow the complete limitation or exclusion of liability and thus some of the above may not apply to you. In no event shall the total liability of Ferra Solutions (Pty) Ltd for all damages, losses and causes of action, whether based on contract, tort, strict liability or any other legal basis or theory, arising from the use of this web site or fdm application, exceed in aggregate an amount equal to the annual subscription fee or once-off purchasing price of the application, whichever may apply, or, in the event that both apply, the lesser of the two amounts.
